TERMS AND CONDITIONS

1. SCOPE

These Terms and Conditions apply to all orders placed by consumers through the Felluno online shop.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

Any conflicting or differing terms and conditions of the customer shall not apply unless Felluno has expressly agreed to them.

3. CONCLUSION OF THE CONTRACT

The presentation of products in the online shop does not generally constitute a legally binding offer to enter into a purchase contract.

The customer may select the desired products and add them to the shopping basket.

Before submitting the order, the customer can review and, where necessary, correct the information provided.

By clicking the button that completes the order and creates an obligation to pay, the customer submits a binding offer to enter into a purchase contract for the goods contained in the shopping basket.

After the order has been received, the customer will receive an electronic confirmation.

The purchase contract is concluded when Felluno expressly accepts the customer's offer or dispatches the goods, unless otherwise indicated by the specific ordering process.

4. PRICES AND PAYMENT

All prices stated in the online shop are total prices including any applicable statutory VAT, where applicable.

Any additional delivery charges will be displayed to the customer before the order is completed.

The available payment methods will be displayed during the checkout process.

Payment is due in accordance with the payment method selected during checkout.

Where payments are processed by external payment service providers, their respective contractual terms and privacy policies may also apply.

5. DELIVERY

Delivery will be made to the delivery address provided by the customer during the ordering process.

Available delivery areas, delivery charges and estimated delivery times will be stated in the online shop or during the checkout process.

If delivery is significantly delayed or an ordered item is exceptionally unavailable, the customer will be informed accordingly.

The customer's mandatory statutory rights remain unaffected.

6. RETENTION OF TITLE

The goods supplied remain the property of Felluno until the purchase price has been paid in full.

7. RIGHT TO CANCEL

Consumers generally have a statutory right to cancel distance contracts.

Details regarding the conditions, deadlines and consequences of cancellation, as well as the model cancellation form, are set out in our separate Cancellation Policy.

The Cancellation Policy forms part of the consumer information provided in the online shop.

8. RETURNS

Information on how to return goods and any direct return shipping costs payable by the customer can be found in our Cancellation Policy or Returns Policy.

The consumer's statutory rights are not restricted by these provisions.

9. DEFECTS AND STATUTORY RIGHTS

Statutory rights relating to defective goods apply.

If an item is delivered damaged, defective or does not correspond to the order, we ask the customer to contact Felluno as soon as reasonably possible at:

so that the matter can be dealt with.

Failure to contact us in this way does not result in the loss of any statutory rights relating to defective goods.

10. PRODUCT PRESENTATION

We make every effort to display product images, colours, dimensions and other product information as accurately as possible.

Due to differences in screen and device settings, colours in particular may differ slightly from the actual appearance of the product.

The agreed characteristics of the relevant product and applicable statutory requirements shall remain decisive.

11. LIABILITY

Felluno shall have unlimited liability for damage caused intentionally or through gross negligence, as well as in cases where liability is mandatory by law.

In the event of a slightly negligent breach of essential contractual obligations, liability shall be governed by applicable law and may, to the extent legally permitted, be limited to foreseeable damage typical of the contract.

Mandatory statutory liability provisions, including product liability law, and liability for death, personal injury or damage to health remain unaffected.

12. INTELLECTUAL PROPERTY

Content contained within the online shop, including text, photographs, graphics, logos, designs and other content, may be protected by copyright, trade mark rights or other intellectual property rights.

Any use, reproduction, modification or distribution of such content beyond what is permitted by law requires the consent of the relevant rights holder.

13. DATA PROTECTION

Information regarding the processing of personal data can be found in our separate Privacy Policy.

14. APPLICABLE LAW

The law of the country in which Felluno has its registered place of business shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG), to the extent legally permitted.

For consumers, this choice of law applies only insofar as it does not deprive them of the protection granted by mandatory provisions of the law of the country in which they have their habitual residence.

15. DISPUTE RESOLUTION

Where there is a statutory obligation to provide such information, Felluno will inform consumers whether Felluno is willing or required to participate in dispute resolution proceedings before a consumer arbitration or dispute resolution body.

16. FINAL PROVISIONS

If individual provisions of these Terms and Conditions are or become invalid or unenforceable, the remaining provisions shall generally remain unaffected.

The relevant statutory provisions shall apply in place of any invalid or unenforceable provision.
